As from November companies in the UK wishing to hire staff from overseas will be required to have a sponsorship licence as part of the country’s new Tier system of immigration.
Elaine McIlroy, an associate with the employment law team at Dundas & Wilson, has clarified the issue saying that firms who are not ready for the introduction of the new points-based immigration system could face delays in employing personnel from overseas.
She pointed out that the new system places greater responsibility on employers.
Ms McIlroy said: “For example, if migrant workers are absent from work for certain periods, or if the employer suspects that the migrant is breaching his immigration conditions, the employer must report that to the UK Border Agency.”
